The business employee (please note that is what she is in the eyes of the law regardless of who owns the business ) Is entitled to rights under TUPE and dependant on time served my well be entitled to maternity pay - she also has maternity rights which include not being discriminated against for reasons of maternity but also all the rights she would have under her contract as if she was not on maternity leave ie Holiday pay ect. For employees without a written contract there is such a thing as an implied contract of employment. Please take legal advice before you do anything, please note employment tribunerals are designed to look after the interests of an employee and you would (as the employer ) be expected to prove your case not the other way round.
