My standard bay is in a huge pot and obviously has an ants nest in it (black ones) will they do any harm and if yes how do I get rid without harming the tree?

Try a spray of fairy liquid and water, its an organic way of getting rid of em.

....and as it's bay so you can't do much harm to it, I'd stand the pot in a shallow dish, fill up flowerpot with water....and let it stay in the dish for the rest of the summer...floods the buggers out and stops them getting back in underneath...found this was the only thing that worked with my olive tree....couple of dots of washing up liquid when you fill up pot breaks the surface water tension so will flood their nests.......

The ants' nest may not be in the pot itself.

The ants carry their eggs somewhere nice and warm during the day which acts an as incubator and a plant pot is ideal for this.

Then the ants will take them home to their nest at night!

If you loook in the pot early in the morning and last thing at night when it is cool, you will probably see a huge difference in the amount of activity that's going on at mid-day..
